Driver Does Not Believe Government Can Make Him Carry a License While Driving

A Fairbury man disputes the government's right to require him to carry a license while driving a vehicle and intends to take his case to court.Cameron D. May, age 54, was arraigned in Jefferson County Court Wednesday morning, July 2, 2025. Lida Bauer was the presiding Judge. May is charged with driving without a license on his person and improper display of the number of plates. Each charge is a class 3 misdemeanor that carries a $25 fine.May was stopped and cited by deputies with the Jefferson County Sheriff's Office on June 6, 2025.In court, May said he has a valid driver's license. He did not deny that he was not carrying it at the time of the traffic stop. Instead, he indicated that he believes he is not obligated to carry a license while driving.“I don't have to give it up,” May told the court. “It wasn't on me. It was at home. It's valid.”Judge Bauer said, “actually is a state statute that you have to carry it on you when you're driving, when you're operating a motor vehicle.” When asked how he wanted to plead to the charges, May said, “I'm not going to enter any kind of plea.”Bauer said, “Well, if you stand mute, then I'll enter a not guilty plea on your behalf, and then we'll set it for trial.”“Cool,” said May. “Do what you gotta do.” May then asked, “So, does this fall under administrative law by chance?”“No,” said Judge Bauer.A bench trial is scheduled for August 6, 2025.This is not the only instance in which May intends to fight the government's ability to enforce a law in court. In another case, May is charged with possession of a firearm by a prohibited person, a class 1D felony punishable by three to 50 years in prison.Nebraska law prohibits an individual with a felony conviction from possessing a firearm. Per Nebraska Revised Statute 28-1206, “The felony conviction may have been had in any court in the United States, the several states, territories, or possessions, or the District of Columbia.” On November 15, 2023, at approximately 1:30 p.m., the Jefferson County Sheriff's Office received a tip from an individual who reported May is a convicted felon and was in possession of firearms.According the Affidavit for Arrest Warrant, the reporting party sent photos in which four different firearms were identified: a Glock 48, a 45 caliber 1911, a 12-gauge pump shotgun, and an AR-15 style rifle.May has indicated his intention to challenge the constitutionality of the prohibition of felons having firearms. A trail for that matter is scheduled for July 29 and 30.
