Fairbury Man Gets One Year for Probation Violation

A Fairbury man on was sentenced to one year in jail after violating his probation.Cory L. Nutsch, age 34, appeared in Jefferson County District Court on Thursday, November 6, 2025. David J.A. Bargen was the presiding judge. Nutsch was placed on probation on Thursday, April 3, 2025 in Jefferson County District Court.Nutsch was originally charged with possession of methamphetamine, a class 4 felony punishable by up to two years in prison, nine to 12 months of post-release supervision and a $10,000 fine. He was also charged with possession of drug paraphernalia, an infraction that carries a $100 fine.In accordance with a plea agreement, Nutsch pleaded guilty to a reduced charge of attempted possession, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine. The paraphernalia charge was dismissed. A term of his probation is that Nutsch must allow searches of his residence.On May 8, 2025, District One probation officers requested assistance from Jefferson County Deputies for a probation search. According to the arrest affidavit, “they received information that he had drugs, drug paraphernalia and a fire arm inside of his residence.” The affidavit indicates a search uncovered, “Sitting on top of a dresser was a glass container that contained approximately 40 Zig-Zag Slow Burning paper packets (upon inventorying discovered they were all empty). In this dresser, in a top-drawer Probation located a glass pipe with Marijuana residue, a metal tray containing, Pink colored grinder, rolling papers, metal forceps with burnt ends, metal hook, tooth picks, a hair root coloring brush, a green colored piece of plastic with Marijuana residue and burnt roach that smelt of the odor of Marijuana and a glass jar containing Marijuana buds which field tested positive as Marijuana. Also located in this drawer was a package labeled 'STAR BUDS, THC contains Marijuana', a 4 mg Naloxone Nasal Spray, a Green colored grinder, two (2) Watermelon Blast Vapes 'Juice That Gets You High', two (2) metal forceps with burnt ends, a pack of Zig-Zag papers. Also located in this dresser was a Black colored, zip lock type bag with a zip lock baggie that contains what I believe to be from my training and law enforcement experience to be Psilocybin Mushrooms.”Also located in the residence was a glass bong and a Colt 45 handgun. The defendant’s attorney, Gregory Kratz, told the judge, “Mr. Nutsch no longer wishes to be on probation.”Kratz asked for a 60-day sentence for his client.Judge Bargen sentenced Nutsch to 365 days in jail, with credit for two days time served. Nutsch was then remanded to the custody of the Jefferson County Sheriff’s office to execute the sentence.
