Alexandria Man Sentenced for Assault with Beer Bottles and Frozen Hamburgers

An Alexandria man was sentenced to three years in the Nebraska Department of Corrections after pleading No Contest to assaulting two people with beer bottles and frozen hamburger patties.Jesse Durflinger, 31, of Alexandria, appeared in Thayer County District Court on Tuesday, December 5, 2023. David J.A. Bargen was the presiding judge.The defendant was originally charged with second degree assault, a class 2A felony that carries a sentence of up to 20 years in prison. He was also charged with terroristic threats, a class 3A felony that carries a sentence of up to three years in prison, 18 months of post-release supervision and a $10,000 fine.In accordance with a plea agreement, Durflinger pleaded No Contest to reduced charges of assault causing bodily injury, a class 1 misdemeanor punishable by up to one year imprisonment and a $1,000 fine, and attempt of a class 3A felony, which is a class 4 felony, punishable by a maximum of two years imprisonment and one year of post-release supervision.On August 8, 2023, at approximately 9:53 p.m., the Thayer County Sheriffs Office received a call, reporting that Durflinger had threatened the life of the reporting party and another individual.Thereafter, deputies arrived at a residence in Alexandria and made contact with Durflinger. According to the Warrantless Arrest Affidavit, “Jesse appeared to be high. Jesse stated he had just been smoking weed. Jesse was detained and put in the back of the patrol unit.”A deputy spoke with the alleged victims, who, “advised me that Jesse had thrown beer bottles and frozen hamburger patties.”For the assault charge, Judge Bargen sentenced Durflinger to one year in prison, with credit for 118 days time served. For the charge of attempt of a class 3A felony, Durflinger was sentenced to two years. The sentences are to run consecutively.
