Another Warrant Issued for Jody Duke

A Fairbury man who had a warrant for his arrest issued last week for missing court once again failed to appear and another warrant was issued for his arrest.Jody W. Duke, age 40, was scheduled to be arraigned in Jefferson County Court on Wednesday, December 13, 2023. Linda Bauer was the presiding judge.In this case, Duke is charged with attempt of a class 1 misdemeanor, which is a class 2 misdemeanor, and criminal mischief, which is a class 3 misdemeanor.According to the Warrantless Arrest Affidavit, on November 9, 2023, at approximately 7:47 a.m., 911 received a call from an “individual in the house that was witnessing Jody W. Duke trying to break into the house.”A deputy reported that, upon arrival,“I witnessed Jody Duke standing in front of a window on the north side of the house. When I made contact with Jody Duke, I noticed that the window had been broken in and the screen cover was on the ground. Jody Stated that he didn't know what had happened and that he didn't break the windows and was not trying to get in the house.”The deputy noted, “Jody also had a small cut with fresh blood on one of his left-hand knuckles.”Duke was arrested at the scene and later released on a personal recognizance bond.As noted above, a previous warrant was issued for Duke after he failed to appear for court in Jefferson County District Court on Thursday, December 7, 2023. David J.A. Bargen was the presiding judge.In that case, Duke is facing a felony for failing to update his address with Nebraska Sex Offender Registry. This is not the first time he has been accused of this offense, making the charge a felony.Duke is a person subject to the Nebraska Sex Offender Registration Act as a 15-year offender. He is charged with violating the Sex Offender Registry Act by failing to report a change of address as required. The charge is a class 3A felony punishable by up to three years in prison, plus nine to 18 months of post-release supervision and a $10,000 fine.On April 18, 2013, Duke was convicted in Jefferson Count of third-degree sexual assault and attempted third-degree sexual assault of a child.Any person required to register under the act shall inform the sheriff of the county in which he or she resides, in person, and complete a form as prescribed by the Nebraska State Patrol for such purpose, if he or she has a new address, temporary domicile, or habitual living location, within three working days before the change. According to the Affidavit in Support of Arrest, Duke failed to do that.Duke has a string of prior arrests and convictions in Jefferson County, including other charges of violating the Sex Offender Registry Act. Most recently, on March 10, 2023, Duke was sentenced to 365 days in jail, with credit for 65 days times served, for the same charge in Jefferson County Court.
