Attorney Motions to Withdraw from Fairbury Drug Case

Dustin Garrison, the attorney for Justin B. Vorderstrasse, age 30, of Fairbury, has filed a motion with the Jefferson County District Court to withdraw from his case.In that case, Vorderstrasse is charged with possession of a controlled substance, a class 4 felony, punishable by up to two years incarceration, nine to 12 months of post-release supervision and a $10,000 fine. He is also charged with driving under a suspended license, driving without a valid registration and invalid or defective lighting, all class 3 misdemeanors.The defendant was arrested Tuesday night, December 19, 2023, during a traffic stop.Vorderstrasse was scheduled to be arraigned on this matter on August 1, 2024, but neither he nor his attorney appeared. In the motion, dated Tuesday, August 27, Garrison explained his reason for withdrawing, “undersigned counsel shows to the court that there has been an irreconcilable breakdown and the attorney/client relationship; undersigned counsel is no longer able to represent defendant in this matter as a result.”Garrison had filed a previous motion to withdraw on July 31, noting that he “has attempted to contact the defendant on several occasions with no success. Defendant has also failed to satisfy his obligations to counsel.” Arraignment has been rescheduled for September 9. Another attorney, Gregory Kratz, has indicated he will be representing Vorderstrasse in this matter. Another Jefferson County CaseKratz already represents Vorderstrasse in another case.Vorderstrasse is charged with one count of attempt of a class 4 felony, which is a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine, and one count of second degree trespassing, a class 3 misdemeanor punishable by up to three months in jail and a $500 fine.According to the citation on file in the court record, on June 23, 2024, at approximately 5:00 a.m., the defendant allegedly attempted to remove “construction materials” belonging to a business without authorization. Thayer CountyVorderstrasse also has a case pending in Thayer County. In that case, he is being held on the charges of burglary, possession of burglary tools, theft by unlawful taking criminal mischief. According to the Thayer County Sheriff's office, subsequent investigation resulted in recovery of a stolen Yamaha Grizzly located in Carleton.
