Barneston Man Charged with Assaulting Police Officer in Beatrice Bar

A Barneston man has been charged with assaulting a police officer after an altercation in a bar in Beatrice.Adrian Newby, age 20, of Barneston, is charged with third degree assault of a peace officer, a class 3A felony punishable by up to three years in prison, plus nine to 18 months of post-release supervision. He is also charged with attempt of a class 3 or 3A felony, which is a class 4 felony; first offense resisting arrest, a class 1 misdemeanor; and minor in possession of alcohol, a class 3 misdemeanor.At approximately 2 a.m., Sunday, November 6, 2022, officers with the Beatrice Police Department were dispatched to Bigg’s Bar in Beatrice, responding to a report of a physical disturbance. According to the Arrest Affidavit, Newby was on the promises and the identification he presented to police showed he was not yet 21 years of age. The affidavit noted that when police attempted to give Newby a citation for minor in possession, “Newby attempted to walk away and leave the scene.”When an officer attempted to prevent Newby from leaving, the defendant allegedly “attempted to punch” the officer.The affidavit indicates Newby was then wrestled to the ground. In the scuffle, one of the officers received an injury to the knee and required medical attention. The officer that filled out the affidavit also stated, “Newby did not comply and resisted putting his hands behind his back to be placed in handcuffs. Newby also did not comply and resisted getting into my patrol cruiser.”The defendant was arraigned in Gage County Court on November 29, 2022. Another hearing is scheduled for December 13, 2022. Newby remains free on a $7,500 (10 percent) bond at this time.
