Brandon Imes Misses Another Court Date

Jefferson County Judge Linda Bauer set one last hearing for court cases that have been pending for over a year.After multiple missed court dates and multiple warrants issued for his arrest, Brandon L. Imes, age 33, of Plymouth, once again failed to appear for court in Jefferson County as scheduled on Wednesday, November 2, 2022.Imes is facing charges in three separate cases and was scheduled to be sentenced in two of them at 1:15 p.m. His attorney, Lee Timan, was present in court and indicated he had not heard from his client.At approximately 1:25 p.m., the defendant called the court by phone and indicated he had fallen asleep, “I thought I had court at two, but I think I have COVID.”Judge Bauer said, “I’m not really buying it, that you have COVID.”Imes said, “I just woke up.”“I believe you just woke up. That’s the only part I believe,” said the judge.Timan asked for a continuance, “I understand the court might be frustrated.”Judge Bauer said she was unable to hold a sentencing hearing via telephone and agreed to continue the cases until November 21, but also indicated this would be the last continuance.The ChargesImes pleaded guilty to driving without a valid license on Wednesday, November 24, 2021. He was charged with driving under a revoked operator's license, second offense, a class 2 misdemeanor that carries a possible penalty of six months in jail, a $1,000 fine and his license could be further revoked for another two years.When the defendant was arraigned in that case on February 10, 2021, County Attorney Joseph Casson was asked by Judge Bauer if he indented to seek jail time for the offense. Casson said, “Absolutely.”In another case, Imes is charged with driving under a suspended operator's license, a class 3 misdemeanor, alleged to have occurred on September, 2021. He pleaded guilty.Imes has not yet pleaded in a third case of driving under a suspended operator's license, alleged to have occurred on November 18, 2021.Cases in Other CountiesThe County Attorney noted that the defendant had four cases currently pending in other counties; two in Lancaster County and one each in Sarpy and Gages counties.In Lancaster County, Imes is charged with escape while under arrest on a felony charge, which is a class 3A felony. He went missing from the Community Corrections Center in Lincoln when did not return as scheduled on November 26, 2020, from his work assignment in the community. The electronic monitoring device he was wearing had been disabled.Imes has failed to appear for court in Gage County on multiple occasions. He was scheduled for a hearing on Tuesday, December 28 and, after he did not appear, Jeffrey A. Gaertig, the presiding judge, issued a warrant for his arrest. He was arrested the next morning.
