Burning Motorcycle was Reported Stolen

Nicholas S. Heitman, age 36, was arraigned in Jefferson County Court the morning of Wednesday, May 3, 2023. Linda Bauer was the presiding judge. Both the defendant and County Attorney Joseph Casson appeared via webcam.Heitman is charged with one count of receiving stolen property with a value between $1,500 and $5,000, a class 4 felony punishable by up to two years in prison and up to a $10,000 fine. The defendant may also be responsible for restitution.On October 28, 2022, the Jefferson County Sheriff's office was contacted to investigate the report of a burning motorcycle at 17th and K Streets in Fairbury. After the fire was extinguished, the VIN number was run through the National Crime Information Center (NCIC) and the vehicle was listed as stolen out of Omaha.According to the Affidavit for Arrest Warrant, law enforcement determined the motorcycle was in Heitman's possession by speaking to people at the scene. The affidavit also noted, “A black ball cap believed to be Heitman's was also located at the scene where witnesses observed someone working on the bike prior to it catching fire along "K" Street. A white flatbed truck attempted to tow the motorcycle down the driveway at 1702 "K" Street and the motorcycle was on fire. The log chain was taken off the flatbed truck in the driveway and abandoned along with the burning motorcycle.”Heitman requested court-appointed counsel and attorney Timothy S. Noerrlinger was assigned to represent him. Noerrlinger also represents Heitman in two Gage County District Court cases.In each of those cases, the defendant is charged with possession of a controlled substance, methamphetamine, with the intent to deliver, a class 2 felony punishable by up to 50 years in prison.Another hearing is scheduled for May 24.
