Jody Duke Arrested Again

Jody W. Duke, 40, of Fairbury, appeared in Jefferson County Court on Wednesday, February 22, 2023, in the custody of the Jefferson County Sheriff's Office. Linda Bauer was the presiding judge.Duke is a person subject to the Nebraska Sex Offender Registration Act as a 15-year offender. He is charged with violating the Sex Offender Registry Act, a class 3A felony punishable by up to three years in prison, plus nine to 18 months of post-release supervision and a $10,000 fine.On April 18, 2013, Duke was convicted in Jefferson Count of third-degree sexual assault and attempted third-degree sexual assault of a child.Duke received his “Notification of Registration Responsibilities Under Nebraska Sex Offender Registration Act” on March 10, 2014. This form details his reporting requirements as a registered sex offender under Nebraska Law.Any person required to registered under the act shall inform the sheriff of the county in which he or she resides, in person, and complete a form as prescribed by the Nebraska State Patrol for such purpose, if he or she has a new address, temporary domicile, or habitual living location, within three working days before the change. According to the Affidavit in Support of Arrest, Duke failed to do that.Duke has a string of prior arrests and convictions in Jefferson County, including other charges of violating the Sex Offender Registry Act.The defendant had been out on a PR (Personal Recognizance) bond while he attended a treatment program. A condition of that bond is that Duke not consume any alcohol.On February 1, 2023, a motion to revoke the bond was filed by the county attorney. The motion stated, in part, “That regardless of and notwithstanding the conditions of said bond the defendant left treatment and returned to Fairbury, Nebraska without reporting to the Jefferson County Jail and on January 30, 2023 the defendant was contacted by law enforcement in Fairbury, Nebraska and had been consuming alcohol.”A warrant was issued for Duke's arrest.Duke is represented by Public Defender Scott Gropp, who told the court his client had been released from treatment with no aftercare, “There was no support system after that.”Gropp and Casson had discussed getting Duke back into treatment.“How many times has Mr. Duke been to treatment?”Judge Bauer asked.Neither Gropp nor Casson new the exact number but both acknowledged it was multiple times.“There is a thing called personal responsibility,” said Judge Bauer. “I feel its not an appropriate use of resources and I'm not going to be a part of it.”Then the court addressed the subject of bond. Casson recommended $5,000 (10 percent) and Gropp agreed.The judge set bond at $10,000 (10 percent).Another hearing is scheduled for March 8, 2023.Duke remains in custody as of press time.
