Court Rejects Aubrey Trail’s Motion
To Fire Attorneys, For Now

The Nebraska Supreme Court has denied a motion filed by Aubrey Trail to dismiss his attorneys and represent himself in the appeal of his murder conviction. This decision may be only temporary.According to the motion in the court file, “The defendant and his attorney's (sic) have reached an impasse as to how current matters be handled before this court and have no hope of resolving these differences.”According to court documents, the motion was overruled due to Trail's “failure to serve Appellant's court-appointed counsel.”However, the motion was overruled “without prejudice,” meaning the motion can be brought before the court again. In a written response to the decision, Trail insisted that he did serve a copy of the hand-written letter he filed to the Attorney General via U.S. Postal Service. Trail noted, however, “I have no access to a mailbox or any way to track anything. I hand my outgoing mail to a guard, case worker or other staff member and it goes threw (sic) several hands before reaching the mail room.”Trail, 55, was convicted on July 10, 2019, in Saline County District Court of first-degree murder and conspiracy to commit murder in the death of Sydney Loofe. He pleaded guilty to a count of improper disposal of human remains but, during the course of the trial, maintained that Loofe's death was an accident. The jury of six men and six women deliberated for three hours before reaching a verdict.Trail was sentenced to death on June 9 of this year.Trail is represented by attorneys Benjamin Murray and Joseph Murray of Murray Law, P.C., L.L.O., in Hebron, who are currently working in Trail's appeal. While Trail has indicated he does not wish to appeal his sentence, an appeal is automatic in Nebraska for death penalty cases.Trail's co-defendant in the homicide case, Bailey Boswell, was convicted on October 4, 2020. The State has asked for the death penalty for Boswell, as well. The sentencing hearing is scheduled for Monday, November 8, in Saline County.
