Defendant Carried Concealed Gun Too Soon

A Texas man was charged with carrying a concealed weapon less than two months before such activity will no longer be considered a crime.
As of September 10, 2023, Nebraska will no longer require people 21-years-of-age or older, who are not prohibited from firearm possession, to obtain a concealed carry permit, background check, or safety training to carry hidden, loaded guns in public.
Javari D. Miller, age 19, of Witchita Falls, Texas, appeared in Jefferson County Court on Wednesday, August 9, 2023. Linda Bauer was the presiding judge.
He was cited on July 26, 2023, for carrying a concealed weapon, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine, and possession of less than one ounce of marijuana, an infraction that carries a $300 fine.
Referring to the gun charge, County Attorney Joseph Casson noted, “With the change in the law in some months, this would not be illegal.”
Miller was fined $100 for concealed carry and $300 for marijuana possession.
