Defendant Wants to be Paid for Appearing in Court

A Beatrice man pleaded Not Guilty to a charge of driving without insurance in Jefferson County Court on Wednesday, August 2, 2023. He asked the court about being reimbursed for his time spent in court. Linda Bauer was the presiding judge.Driving without insurance is a class 2 misdemeanor punishable by up to six months in jail and a $1,000.Robert S. Hillard, age 51, disputed the state's claim that he did not have insurance. County Attorney Joseph Casson told the court that the office that conducted a traffic stop that led to the citation ran a check and indicated there was no insurance.Hillard was unwilling to plead guilty or no contest.Judge Bauer said, “I'm sorry but if the state's not willing to dismiss it, I have to set it for a trial.Hillard asked for the judge to dismiss the case. The judge said, “I can't without proper foundation.”The defendant insisted the car was insured at the time. Judge Bauer told him, “Well, Mr. Casson obviously believes he has information to the contrary.”Hillard again asked for the judge for a dismissal.“We only have arraignments here this morning. I can't try your case here,” said the judge. “It's not my decision to decide whether the charge should be dismissed right now or not. I have to let the state present their information.”The defendant tried to give the judge something Bauer would not accept it. Hillard said, “The court is failing to accept by exhibit.”Judge Bauer explained, “This is not a trial.”The case was set for a bench trial on August 30.“Should I get a fee, reimbursement for my time and effort?” Hillard said. “Reimburse me for my time.”The judge did not respond to that request.
