Deshler Man Avoids Felony Assault Charge

A Deshler man accused of assault has reached a plea deal with the state that will keep him from having a felony conviction on his record.
Cody M. Cahill, age 38, appeared in Thayer County District Court on March 8, 2024. David J.A. Bargen was the presiding judge.
The defendant was originally charged in Thayer County District Court with first degree assault, a class 2 felony punishable by one to 50 years in prison; and two counts of third degree sexual assault, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine.
In accordance with a plea agreement, Cahill withdrew his not guilty pleas and pleaded no contest to one count of assault causing bodily injury and one count of assault by threatening or menacing manner, both class 1 misdemeanors. The deal also means Cahill will not have to register with the Nebraska Sex Offender Registry.
On July 10, 2022, deputies with the Thayer County Sheriff’s Office were dispatched to the Hebron Country Club at approximately 1:47 a.m. in response to a report of an assault. Cahill was arrested at the scene. The alleged victim was taken to a hospital and, according to the arrest affidavit, “has suffered a fractured skull and had some internal bleeding on the brain.”
Cahill was originally just charged with first degree assault. The two sexual assault charges came later. Because of the nature of the alleged offenses, portions of the court file is sealed.
Judge Bargen ordered a PSI (Pre-Sentencing Investigation). Sentencing is scheduled for May 7, 2024.
