Diller Man Faces Drug, Weapon Charges in Gage County

David Eugene Sutton, age 56, of Diller, is facing drug and weapon charges in two cases in Gage County.In one case, Sutton is charged with possession of a deadly weapon by a prohibited person, a class 3 felony, and another count of driving under a suspended license.A Gage County deputy conducted a traffic stop on September 18, 2022. The driver was identified as David Sutton and a record check confirmed his license had been suspended. According to the arrest affidavit as filled out by the deputy, “While making contact with David Sutton, I observed a large machete sitting on top of the front dashboard on the driver's seat above the steering wheel. I pulled the machete out and I immediately recognized it to be over 3 ½ inches long in blade length.”In the other case, Sutton is charged with two counts of possession of a controlled substance, a class 4 felony; driving under a suspended license, a class 3 misdemeanor; and two counts of possession of drug paraphernalia, an infraction.On September 23, 2021, Gage County deputies responded to a report of a suspicious vehicle. The vehicle was identified as belonging to Sutton. According to the arrest affidavit, “It was also discovered that a catalytic converter had been cut off from another junk vehicle on the property.”Sutton's vehicle was towed.Sutton reported to the sheriff's office on October 6, 2021 and consented to a search of his vehicle. According to the arrest affidavit, “During the search I located a glass meth pipe with white residue. The residue pre-tested positive for methamphetamine. Sutton denied that the meth pipe was his but stated that he had friends who smoked meth.”The defendant is represented in both cases by attorney Lee Timan.Sutton was arrested in Wymore on a warrant out of Jefferson County on September 9, 2022. A warrant was issued for Sutton’s arrest after failing to appear for court in Jefferson County Court on August 17, 2022. Linda Bauer was the presiding judge. Sutton was scheduled to be arraigned on a charge of driving under a suspended license. The defendant had previously signed a citation promising to appear.Arraignment in Gage county District Court is scheduled for February 22, 2023.
