Diller Man Gets Four Years for Drug Charges in Gage County

David Eugene Sutton, age 56, of Diller, was sentenced to a total of four years in prison for two separate District Court cases. Rick A. Schreiner was the presiding judge.In one case, Sutton was charged with possession of a controlled substance, a class 4 felony punishable by up to two years in prison, nine to 12 months of post-release supervision and a $10,000 fine; possession or attempt to obtain legend drugs, a class 3 misdemeanor punishable by up to three months in jail and a $500 fine; possession of less than one ounce of marijuana, an infraction that carries a $300 fine; and possession of drug paraphernalia, an infraction that carries a $100 fine.On January 24, 2023, the Gage County Sheriff's Office executed a search warrant at a residence in Wymore. According to the arrest affidavit, Sutton had been staying there “for the past several months.”The affidavit also indicated, “During a search of the bedroom, deputies located a glass meth pipe, a plastic baggie containing approximately 0.7 grams of a white crystal substance, a digital scale with white residue, a spoon with white residue, and two empty syringes and needles,” and “On the nightstand on Sutton’s side of the bed, deputies located a glass marijuana pipe and a marijuana grinder with a small amount of marijuana.”Sutton was taken into custody at the scene. He later pleaded guilty to all charges and was sentenced to two years in prison, with credit for 42 days time served, along with 12 months of post-release supervision for the felony charge. He was sentenced to three months in prison for the legend drugs charge. He was fined $300 for the marijuana charge and $100 for the drug paraphernalia charge.In the other case, Sutton was charged with two counts of possession of a controlled substance, a class 4 felony; driving under a suspended license, a class 3 misdemeanor; and two counts of possession of drug paraphernalia, an infraction.On September 23, 2021, Gage County Deputies responded to a report of a suspicious vehicle. The vehicle was identified as belonging to Sutton. According to the arrest affidavit, “It was also discovered that a catalytic converter had been cut off from another junk vehicle on the property.”Sutton's vehicle was towed.Sutton reported to the Sheriff's Office on October 6, 2021 and consented to a search of his vehicle. According to the arrest affidavit, “During the search I located a glass meth pipe with white residue. The residue pre-tested positive for methamphetamine. Sutton denied that the meth pipe was his but stated that he had friends who smoked meth.”Sutton pleaded guilty to all charges in that case as well. He was sentenced to two years for each felony drug possession, with credit for 39 days time served; three months for driving under a suspended license, which was revoked for one year; and he was fined $200 for the drug paraphernalia charges.Some of the prison sentences were set to run concurrently, meaning at the same time, while other were to run consecutively, meaning one after the other. The total sentence amounts to four years in prison.
