Duke Pleads Guilty to Misdemeanors, Still Faces Felony Charge

A Fairbury man pleaded guilty to attempted trespass and criminal mischief and sentenced to one week in the Jefferson County jail.Jody W. Duke, age 40, appeared in Jefferson County Court on Wednesday, December 20, 2023, via webcam from the county jail and Linda Bauer was the presiding judge.He was scheduled to be arraigned December 13 but failed to appear. A warrant was issued for his arrest.Duke was charged with attempt of a class 1 misdemeanor (trespass), which is a class 2 misdemeanor, and criminal mischief, which is a class 3 misdemeanor.According to the Warrantless Arrest Affidavit, on November 9, 2023, at approximately 7:47 a.m., 911 received a call from an “individual in the house that was witnessing Jody W. Duke trying to break into the house.”Judge Bauer sentenced Duke to seven days in jail, with credit for seven days of time served. However, Duke remains in custody on another case.In that case, Duke is facing a felony charge for failing to update his address with Nebraska Sex Offender Registry. This is not the first time he has been accused of this offense, making the charge a felony.Duke is a person subject to the Nebraska Sex Offender Registration Act as a 15-year offender. He is charged with violating the Sex Offender Registry Act by failing to report a change of address as required. The charge is a class 3A felony punishable by up to three years in prison, plus nine to 18 months of post-release supervision and a $10,000 fine.Duke has a string of prior arrests and convictions in Jefferson County, including other charges of violating the Sex Offender Registry Act.
