Endicott Man Pleads Not Guilty to Assault

Christopher L. Day, age 34, of Endicott, appeared in Jefferson County Court on Wednesday, November 2, 2022, in the custody of the Jefferson County Sheriff’s Office. Linda Bauer was the presiding judge.Day is charged two counts of third-degree assault, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine for each count.Day pleaded not guilty.The defendant was originally scheduled to be arraigned on October 26. The defendant had signed a bond promising to appear for court but failed to do so. Judge Bauer issued a warrant for Day’s arrest and also set a new bond at $5,000 (10 percent).Day was picked up on that warrant on October 28.The defendant was originally arrested on September 19, 2022, after Jefferson County deputies responded to a report of an assault at a residence in Fairbury.The defendant is being held on a $5,000 (10 percent) bond. To date, Day has been unable to pay the bond and his attorney, Public Defender Scott Gropp, requested a bond review, “I understand he lives with his family and sometimes there are family altercations.”Gropp said Day’s parents would like to “take back” the charges but they do not want him living with them.Bauer questioned the defendant, who indicated he did not have alternative living arrangements. Bauer opted to continue the bond as set.Another hearing is set for December 21.This is not Day’s first time being accused of assault. On December 30, 2020, Day was sentenced to 50 days in jail, with credit for time served. He was originally charged with third degree assault, a class 1 misdemeanor that carries a possible penalty of one year in jail and a $1,000 fine. He was arrested on October 5, 2020, when the Jefferson County Sheriff's office was distanced to a Fairbury residence to break up a fight between the defendant and his father. In accordance with a plea agreement, Day pleaded guilty to a reduced charge of attempted assault, a class 2 misdemeanor. At that time, Jefferson County Attorney Joseph Casson said, “My understanding is, while Christopher was in custody, we attempted to get evaluations to address the issues which we thought contributed to the commissioner of the crime in the first place. The family ultimately bonded him out. He's living at home now. And they understand what needs to be done and that Christopher was reluctant to do it as part of the case. So, it's going to be a matter, if they choose to allow you to stay in their home, they're going to have to understand he has these issues, which he won't address right here, and the risk of that and if it happens in the future, we'll be back again.”
