Fairbury Man Pleads in Jefferson and Gage Counties

Tanner R. Sell, age 37, of Fairbury, has cases pending in both Jefferson and Gage Counties.Sell appeared in Jefferson County on Wednesday, October 11, 2023.Sell was originally charged with DUI (Driving Under the Influence of Alcohol or Drugs), first offense, a class W misdemeanor that can carry 60 days to a year in jail. He was also charged with unlawful acts relating to drugs, a class 3 misdemeanor, punishable by up to three months in jail and a $500 fine.In accordance with a plea agreement, he pleaded Guilty to attempted possession of a controlled substance, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine. The remaining charges were dismissed.According to County Attorney Joseph Casson, Sell had been found by law enforcement unconscious in a vehicle at 6th and L Streets.According to the County Attorney, Sell had thought he had taken “hydro,” the street name for Hydrocodone. In fact, he had taken methadone. Casson explained that is the reason for the “attempt” charge.Judge Bauer ordered a PSI (Pre-Sentencing Investigation). Sentencing is scheduled for December 13.In a separate case in Gage County, Sell is charged with DUI (Driving Under the Influence of Alcohol or Drugs), a class W misdemeanor that can carry 60 days to a year in jail. He is also charged with transporting a child while intoxicated, a class 1 misdemeanor punishable by up to one year in jail and a $1,000. In addition, Sell is charged with three infractions: possession of one ounce or less of marijuana, possessing and open container of alcohol and possession of drug paraphernalia.Sell was arrested on June 23, 2023, when the Nebraska State Patrol responded to a report of a vehicle that was, according to the arrest affidavit, “all over the road and speeding,” in Beatrice.A traffic stop was initiated at 6th and Logan Streets in Beatrice. The trooper that filled out the affidavit noted, “There was also a 6 year old girl in the back seat asleep.”In accordance with a plea agreement, Sell pleaded No Contest to DUI and possession ot less than one ounce of marijuana. The remaining charges were dismissed. Sentencing is scheduled for November 17, 2023.
