Fairbury Abatement Procedure

The City of Fairbury continues to focus on the abatement of housing considered to be dilapidated or dangerous. While the primary motivation for the condemning and tearing down of such houses is safety, there are other concerns, such as crime rates and the overall appearance of the city.Given the increased emphasis in recent years on eliminating dilapidated housing, FJN reached out to Fairbury Mayor Spencer Brown and asked about the specific process that must be undertaken before a house can be demolished.The first step is when the Code Enforcement Officer identifies a structure as a possible unsafe structure of various degrees, according to the 2021 International Property Maintenance Code (IPMC) guidelines.Multiple pictures are taken of the structure, identifying areas of deterioration, neglect, etc.The property is presented to the Board of Health, which then votes to condemn the structure.Depending on the severity of deterioration, the owner is given an allotted amount of time to either abate or repair the structure according to IPMC guidelines.The owner has 20 days to appeal the determination.Once the allotted time has passed and no progress has been made to repair or abate the structure, the city sends a final notice for abatement.At that time the property is ready for asbestos inspection, asbestos removal, and utility disconnection.Once the above is complete, the city will abate the structure.This procedure is specifically for the City of Fairbury. Other cities or villages may have different policies.
