Fairbury Couple Charged Charged with Child Abuse

A Fairbury couple was arraigned in Jefferson County Court the morning of Wednesday, May 29, 2024, on charges involving the alleged sexual assault of a child. One of the defendants is an employee of Jefferson County. Linda Bauer was the presiding judge. Brandon L. Myers, age 40, appeared in court via webcam from the Thayer County jail, along with his attorney, Benjamin Murray. He is charged with child abuse and third degree sexual assault of a child, both class 3A felonies, punishable by up to three years in prison, 12 to 18 months of post-release supervision and a $10,000 fine. He is also charged with third degree assault, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine. Bobbi J. Meyers, age 44, appeared in court via webcam from the Jefferson County Jail. Her attorney, Gregory Kratz, was in court in person. She is charged with child abuse, a class 4A felony, and failure to report child abuse, a class 3 misdemeanor, which carries a penalty of three months in jail and a $500 fine.An investigation into the couple began in April of this year, when the Nebraska State Patrol received a report of the alleged sexual assault. On Thursday, May 2, investigators arrested Brandon Myers. As Myers is an employee of the Jefferson County Jail, he was lodged in the Thayer County Jail. After further investigation, Brandon Myers’ spouse, Bobbi Myers, was arrested on Monday, May 7.Brandon Myers previously appeared in court on May 8 and requested a bond review. At the time, bond was set at $500,000 (10 percent), which he indicate he was unable to pay and asked for a bond reduction. Judge Bauer agreed to lower the bond to $150,000, which would require the defendant to pay $15,000. The defendant was informed that whatever charges were ultimately filed could impact any future bond.Murray told court reminded the court that the bond was based on possible charges. Now that charged were on file, he requested a “PR (Personal Recognizance) or significantly reduced bond for his client.The Nebraska Attorney General's Office appointed Assistance Attorney General Gail VerMaas to represent the state. “I totally oppose a PR bond,” VerMaas told the court. “I would like to see the bond remain the same.”Judge Bauer agreed a PR bond was not appropriate but lowered the bond again to $100,000 (10 percent). The bond prohibits contact with any minor under the age of 16. There were no charges on file at that time. Bobbi Meyers was being held on a $50,000 (10 percent) bond. She also requested a bond reduction through her attorney, who suggested $10,000. “My client has been in custody for, I believe, three weeks,” said Kratz. “I don't see her as any kind of flight risk.” Again, VerMaas opposed any reduction. Judge Bauer denied the motion, “I think $50,000 is reasonable.” Another hearing is scheduled for June 17, 2024.
