Fairbury Granted Default Judgement In Power Plant Lawsuit

By Gordon HopkinsThe City of Fairbury was granted a motion for default judgment in the ongoing lawsuit against Industrial Engineering Solutions (IES), LLC, the business accused of purchasing, but not paying for, an estimated $120,000 in machinery and equipment from the now defunct municipal power plant.In 2022, the City of Fairbury contracted with Texas-based IES to purchase several large machines from the power plant no longer in use, such as generators, turbines and condensers. The City of Fairbury filed the lawsuit on September 29, 2023, contending IES removed the equipment from the power plant but left town without paying the full, agreed-upon amount. The city did receive a $12,000 down payment from IES when the contract was signed. Also included in the contract was the demolition of an oil tank and disposal of the oil. That was also not completed and the city was forced to foot the bill for that.According to Fairbury Mayor Spencer Brown, the total asked for was $144,823.27. That includes fees and interest, “That includes everything we have paid for to date.”On July 15, 2024, a hearing was held in Jefferson County District Court via Zoom. Attorney Adam Kost with Rembolt Ludtke LLP appeared on behalf of the city. No one appeared on behalf of IES.Julie D. Smith, the presiding judge, granted the motion for default judgment, “The court finds that the allegations in the complaint are deemed to be true. Default Judgment is awarded in favor of the plaintiff and against the defendant.”When asked for comment on the judgment, Mayor Brown told FJN, “I do not have any other updates at this time.”
