Fairbury Man Accused of Sexual Assault Reaches Plea Agreement

A Fairbury man accused of sexually assaulting a 14-year-old has reached a plea agreement with the state.
Dylan L. Busing, age 30, appeared in Jefferson County District Court the morning of Thursday, November 2, 2023, in the custody of the Jefferson County Sheriff’s Office. David J.A. Bargen was the presiding judge.
Busing was originally charged with first degree sexual assault of a child, a class 1B felony, punishable by a minimum of 20 years and up to life in prison. In addition, he will be subject to the provisions of the Nebraska Sex Offender Registry Act.
The defendant is represented by attorney Benjamin Murray.
In accordance with the plea agreement, Busing pleaded No Contest to a reduce charge of attempted first degree sexual assault, a class 2A felony punishable by up to 20 years in prison.
Busing was 29-year-old at the time of the alleged incident. Because the victim is a minor, the arrest affidavit and other court documents are under seal.
Judge Bargen ordered a PSI (Pre-Sentencing Investigation). Sentencing is scheduled for January 14, 2024. Busing remains in custody with a $250,000 (10 percent) as of press time.
