Fairbury Man Accused of Violating Protection Order, Second Offense

Dain C. Zabokrtsky, 38, of Fairbury as arraigned in Jefferson County Court on Wednesday, October 2. Linda Bauer was the presiding judge. Zabokrtsky is charged with violating a protection order, second offense. He was previously convicted of a similar offense on August 19, 2020, making the charge a class 4 felony punishable by up to two years in prison, nine to 12 months of post-release supervision and a $10,000 fine.The defendant has no bond and there is no affidavit on file, so details in the court file are limited.Zabokrtsky requested court-appointed counsel and Paul Payne, an attorney from Lincoln, was assigned to represent him. Judge Bauer noted that Public Defender Scott Gropp has reached his limit for felony cases.Another hearing is scheduled for November 6, 2024. Prior ConvictionsRegarding the previous protection order violation conviction, on April 4, 2020, at approximately 2:15 p.m., the Jefferson County Sheriff's Office received a call, indicating that the defendant had been following the petitioner in a vehicle. According to the Warrantless Arrest Affidavit, the petitioner reported that while she was at a gas pump at Casey's General Store in Fairbury, Zabokrtsky pulled his vehicle behind her and blocked her in. The petitioner also reported receiving phone calls and text messages from Zabokrtsky, which are prohibited by the order.Judge Bauer sentenced Zabokrtsky to 60 days in jail, with credit for three days time served. The sentenced was to run consecutively with the defendant's sentence in a separate case in District Court. When sentences run consecutively, the defendant serves them back to back, as opposed to concurrent sentences, which run at the same time.On Thursday, August 13, 2020, Zabokrtsky was sentenced to 360 days in jail, with credit for four days time served, by District Court Judge Vicky Johnson.In that case, he was charged with making terroristic threats and false imprisonment, both class 3A felonies that carry a possible penalty of three years' incarceration, nine to 18 months post-release supervision and a $10,000 fine. He was also accused of possessing a deadly weapon, a firearm, a class 1C felony punishable by five to 50 years in prison, and domestic assault, a class 1 misdemeanor punishable by one year in jail and a $1,000 fine.In accordance with a plea agreement, the defendant pleaded No Contest to a reduced charge of third degree assault, a class 1 misdemeanor.The other charges were dismissed.
