Fairbury Man Accused of Violating Sex Offender Registration Act

A Fairbury man is facing multiple charges of violating the Nebraska Sex Offender Registration Act.Thomas Van Caudy, age 36, was arraigned in Jefferson County District Court via webcam on Wednesday, February 1, 2023, in the custody of the Jefferson County Sheriff's Office. Linda Bauer was the presiding judge.The defendant is accused of failing to update his sex offender registration as required by law. Caudy is subject to the Sex Offender Registration Act as a lifetime offender. He was convicted of first-degree sexual assault on June 14, 2007 and sentenced on September 13, 2007.The Sex Offender Registration Act requires registrants to notify the local Sheriff’s Office of any change of address within three days.According to the Affidavit for Arrest Warrant, Caudy was arrested by the Jefferson County Sheriff's Office on December 16, 2022, for possession of a controlled substance. Due to his being incarcerated, Caudy's physical address was changed on the registry to the Jefferson County Jail. He was released on January 12, 2023.As of January 27, Caudy had failed to update his address and was classified as absconded.Caudy was previously convicted of violating the Sex Offender Registration Act on June 24, 2022, in Douglas County. Caudy was sentenced to two days in jail and nine months of post-release supervision, which was then quashed when the defendant informed the court he was moving to Hebron.Because this is a second offense, that makes the charge a class 2A felony, punishable by up to 20 years in prison.Caudy was previously arrested on October 4, 2022, on a warrant for violating the Nebraska Sex Offender Registry Act. That case is currently pending in Jefferson County District Court.The defendant requested court-appointed counsel and Public Defender Scott Gropp was appointed to represent him. Caudy is also represented by Gropp in the District Court case.County Attorney Joseph Casson recommended bond be set at $10,000 (10 percent). Judge Bauer agreed.Another hearing is scheduled for February 8, 2023.
