Fairbury Man Accused of Violating the Sex Offender Registration Act

Russell Alan Hodges appeared in Jefferson County Court on Wednesday, January 11, 2023. Linda Bauer was the presiding judge.Hodges was originally charged with violating the Nebraska Sex Offender Registration Act, a class 3A felony punishable by up to three years in prison, plus nine to 18 months of post-release supervision.Hodges is subject to the Sex Offender Registration Act as a 25-year offender. He was convicted on October 31, 1996, in the District Court of Gage County of attempted first degree sexual assault, a class 3 felony.On October 29, 2009 Hodges received his “Notification of Registration Responsibilities Under Nebraska Sex Offender Registration Act,” a form that details his reporting requirements as a registered sex offender under Nebraska Law. Any person required to registered under the act is required to inform the sheriff of the county in which he resides, in person, and complete a form as prescribed by the Nebraska State Patrol if he has a new address, within three working days before the change.Additionally, a person designated as a 25-year registrant, must report in person at the office of the sheriff of the county in which they are registered to complete their verification every six months. This required Hodges to complete his verification during the months of January and July.According to the Affidavit for Arrest Warrant, Hodges had not completed his verification by the end of July, 2022.Deputies also noted that the address at which Hodges was registered, “appeared to be vacant.”In accordance with a plea agreement, the state will reduce the charge to a misdemeanor. Sentencing is scheduled for January 18, 2023.
