Fairbury Man Charge for Driving without a Valid License for the Third Time

A man previously convicted of multiple counts of driving without a valid license has once again been accused of driving while his license is revoked.Joshua V. Poley, age 30, appeared in Jefferson County Count the morning of Wednesday, February 19, 2025. Linda Bauer was the presiding judge. On Monday, January 27, 2025, at approximately 11:40 p.m. Poley was cited for driving while his license was revoked, a class 2 misdemeanor punishable by up to six months in jail and a $1,000 fine.Poley requested court appointed council and Public Defender Scott Gropp was assigned to represent him.The defendant was previously sentenced to jail time for multiple crimes, including driving without a valid license, on Wednesday, September 12, 2024, by Judge Bauer. Driving with a Suspended LicenseIn one case, Poley was charged with driving under a suspended license, a class 3 misdemeanor. On December 6, 2023, Poley failed to appear for court and a warrant was issued for his arrest.Poley was sentenced to 30 days in jail, with credit for 19 days time served. Suspended License and False ReportingIn another case, Poley was charged with criminal impersonation, a class 4 felony; driving under a suspended license, a class 3 misdemeanor; and false reporting, a class 1 misdemeanor.Deputies with the Jefferson County Sheriff's office conducted a traffic stop on March 16, 2024, at approximately 5:20 p.m., near the intersection of 6th and J Streets in Fairbury. The vehicle was a red Cadillac Deville. According to the arrest affidavit, the driver could not provide a license, registration or insurance information. The affidavit also indicates the defendant provided what was later determined to be a false name and date of birth.The driver was placed in the back seat of the deputy's patrol vehicle while paperwork was completed. He was then released after being given a warning violation.Afterwards, at the Jefferson County Sheriffs Office, the deputy download and reviewed the traffic stop camera video. While reviewing the backseat camera video, the deputy say that the suspect called an unknown individual, stating, “I'm probably getting false reporting and possession,” and “I gave them my little brother's name.” According to the deputy, “I then realized that he was, in fact, Joshua Poley, who had two active warrants out of Jefferson County, Nebraska.”Both warrants were for prior charges of driving under a suspended license, for which Poley failed to appear for court in 2023.Poley was sentenced to 30 days in jail, with credit for three days time served. Drug PossessionPoley also pleaded guilty to a charge of attempted possession of methamphetamine, which is a class 1 misdemeanor. He was sentenced to 120 days in jail, with credit for 31 days time served.Judge Bauer ordered that all three sentences run concurrently.
