Fairbury Man Charged as Prohibited Person Possessing a Firearm

A Fairbury man with a felony conviction was arrested for possession of firearms. Felons are not entitled to possess firearms under Nebraska law.Cameron D. May, age 54, appeared in Jefferson County Court on Wednesday, December 13, 2023, via webcam from the Reception and Treatment Center of the Nebraska State Penitentiary. Linda Bauer was the presiding judge.May was arraigned on a charge of possession of a firearm by a prohibited person, a class 1D felony punishable by three to 50 years in prison.On November 15, 2023, at approximately 1:30 p.m., the Jefferson County Sheriff's Office received a call from an individual who reported May is a convicted felon and in possession of firearms. Felons are not entitled to possess firearms in Nebraska.According to the Affidavit for Arrest Warrant, the reporting party sent photos in which four different firearms were identified: a Glock 48, a 45 caliber 1911, a 12-gauge pump shotgun, and an AR-15 style rifle.The affidavit indicates deputies were also provided with photographs of “what appeared to be two military-style ammunition boxes next to a piece of mail.”The defendant's name and address were clearly visible on the mail.The warrant was issued Thursday, November 30, 2023.May was arrested on Wednesday, December 6, 2023, at the Jefferson County Courthouse. He was in court that day to fight a speeding ticket and was arrested after the trial.County Attorney Joseph Casson recommended a $100,000 (10 percent) bond.May asked the judge for an “OR” (Own Recognizance aka Personal Recognizance) bond, “I'm not threat, your Honor, to the community. I'll report to the sheriff's office to three times a week, whatever is required.”Casson objected to an “OR” bond, noting, “Mr. May has a long criminal history.”That criminal history includes felony theft. Casson said, “There are various other charges for domestic violence. Given the nature and circumstances of just this offense alone, I believe justifies the bond recommendation”Judge Bauer said, “I wouldn't be unlikely to 'OR' somebody on a class 1D felony.”May told the judge, “I've no Nebraska crimes, committed no crimes in Nebraska. This is the first. Like I said, I'm not a threat to society.”The judge set bond at $80,000 (10 percent) and said, “With the condition, a bond condition, that you not, obviously, to possess firearms or ammunition, although that's already a law if you're a convicted felon.”May originally said he was going to hire his own attorney but after his request for an “OR” bond was denied, he requested court-appointed counsel. Attorney Benjamin Murray was assigned to represent him.Another hearing is scheduled for January 3, 2024.
