Fairbury Man Charged with Sexual Assault

A Fairbury man appeared in court this week after having been accused of sexual assault.Lynn William Vieselmeyer-Scheetz, age 30, was arraigned in Jefferson County Court on Wednesday, November 13, 2024. He appeared via webcam from the Reception and Treatment Center of the Nebraska Department of Corrections in Lincoln. Linda Bauer was the presiding judge.Vieselmeyer-Scheetz is charged with first degree sexual assault, a class 2 felony punishable by one to 50 years in prison. The incident allegedly took place on October 31, 2024. The affidavit is currently under seal.The defendant was being held on a $150,000 (10 percent) bond. His attorney, Paul Payne, indicated his client was unable to afford that amount and asked for a reduction. Judge Bauer agreed to reduce the bond to $75,000 (10 percent). However, the judge also noted that there was a motion on file to revoke the defendant's post-release supervision in another matter. Motion to Revoke Post-Release SupervisionOn October 5, 2023, Jefferson County District Court Judge David J.A. Bargen sentenced Vieselmeyer-Scheetz to two years, with credit for 162 days time served, to be followed by 18 months of post-release supervision. In that case, Vieselmeyer-Scheets was originally charged with assault by strangulation or suffocation, a class 3A felony punishable by up to three years in prison, plus nine to 18 months of post-release supervision, and third degree domestic assault, a class 1 misdemeanor punishable by one year in jail and a $1,000 fine. The defendant was arrested on April 27, 2023, after deputies with the Jefferson County Sheriff's Office responded to a report of a possible assault at a residence in Fairbury.In another case, Vieselmeyer-Scheets was charged with possession of a firearm by a prohibited person, a class 1D felony punishable by three to 50 years in prison. He is also charged with possession of a deadly weapon (a knife) by a prohibited person, a class 3 felony punishable by four years in prison, nine to 24 months of post-release supervision and a $25,000 fine. As a convicted felon, Vieselmeyer-Scheetz is prohibited from possession of a firearm or other deadly weapons. In 2013, he was convicted in Lancaster County of burglary and theft by unlawful taking, both class 3 felonies. In accordance with the agreement, Vieselmeyer-Scheetz pleaded guilty to a single count of strangulation. The remaining charges were dismissed with prejudice. On October 23, 2024, the Probation Office filed a motion to revoke post-release supervision, alleging multiple violations of the terms of release, including drug use and failing to report as directed.A bench warrant was issued for the defendant's arrest. A preliminary hearing is scheduled for December 4 on the sexual assault case and another hearing is scheduled for December 5 on the motion to revoke post-release supervision.The court file lists Vieselmeyer-Scheetz as a transient.He remains in custody as of press time.
