Fairbury Man Facing Felony Drug Charge While On Probation

A Fairbury man on probation was arrested after drugs were allegedly discovered in his residence by probation officers.Cory L. Nutsch, age 34, was placed on probation on Thursday, April 3, 2025 in Jefferson County District Court. Nutsch was originally charged with possession of methamphetamine, a class 4 felony punishable by up to two year in prison, nine to 12 months of post-release supervision and a $10,000 fine. He was also charged with possession of drug paraphernalia, an infraction that carries a $100 fine.In accordance with a plea agreement, Nutsch pleaded guilty to a reduced charge of attempt possession, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine. The paraphernalia charge was dismissed. A term of his probation is that Nutsch must allow searches of his residence.On May 8, 2025, District One probation officers requested assistance from Jefferson County deputies for a probation search. According to the arrest affidavit, “they received information that he had drugs, drug paraphernalia and a fire arm inside of his residence.”The affidavit indicates a search uncovered, “Sitting on top of a dresser was a glass container that contained approximately 40 Zig-Zag Slow Burning paper packets (upon inventorying discovered they were all empty). In this dresser, in a top-drawer probation located a glass pipe with marijuana residue, a metal tray containing, pink colored grinder, rolling papers, metal forceps with burnt ends, metal hook, tooth picks, a hair root coloring brush, a green colored piece of plastic with marijuana residue and burnt roach that smelt of the odor of marijuana and a glass jar containing marijuana buds which field tested positive as marijuana. Also located in this drawer was a package labeled 'STAR BUDS, THC contains Marijuana', a 4 mg Naloxone Nasal Spray, a green colored grinder, two (2) Watermelon Blast Vapes 'Juice That Gets You High', two (2) metal forceps with burnt ends, a pack of Zig-Zag papers. Also located in this dresser was a black colored, Zip-Lock type bag with a Zip-Lock baggie that contains what I believe to be from my training and law enforcement experience to be Psilocybin Mushrooms.”Also located in the residence was a glass bong and a Colt 45 handgun. Nutsch was arraigned in Jefferson County Court on Wednesday, June 18. Linda Bauer was the presiding judge.The new charges are: possession of a controlled substance, class 4 felony; possession of less than one ounces of marijuana, an infraction, and possession of drug paraphernalia, also an infraction.Another hearing is scheduled for July 23. The defendant is currently free on $5,000 (10 percent) bond.This is not the defendant's first dealing with the court system.A bench trial was held for Nutsch in Jefferson County Court on Wednesday, July 3, 2024. Linda Bauer was the presiding judge. The defendant had been charged with first degree criminal trespass, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine. An additional charge of failure to appear for court was later added. Nutsch was originally arrested on June 7, 2023. He was free on a $3,500 (10 percent) bond but did not appear for a hearing on August 9, 2023. County Attorney Joseph Casson requested the warrant, which was granted by Judge Bauer, and a new bond was set at $3,500 (10 percent). Failure to appear is a class 2 misdemeanor, punishable by up to six months in jail and a $1,000 fine.The county attorney had previously offered to dismiss the criminal trespass charge if Nutsch would plead guilty or no contest to the failure to appear charge. Nutsch rejected the offer and the case was set for trial. Judge Bauer found Nutsch not guilty of trespass but guilty of failing to appear for court and sentenced him to three days in jail, with credit for three days time served. He was also fined $150.
