Fairbury Man Gets Two Years for Strangulation

A Fairbury man accused of strangulation was sentenced to two years in prison.Lynn William Vieselmeyer, age 28, appeared in Jefferson County Court District on Thursday, October 5, 2023, in the custody of the Jefferson County Sheriff's Office. David J.A. Bargen was the presiding judge.Vieselmeyer was facing multiple charges in multiple cases.In one case, Vieselmeyer was originally charged with assault by strangulation or suffocation, a class 3A felony punishable by up to three years in prison, plus nine to 18 months of post-release supervision, and third degree domestic assault, a class 1 misdemeanor punishable by one year in jail and a $1,000 fine.The defendant was arrested on April 27, 2023, after deputies with the Jefferson County Sheriff's Office responded to a report of a possible assault at a residence in Fairbury.In another case, Vieselmeyer was charged with possession of a firearm by a prohibited person, a class 1D felony punishable by three to 50 years in prison. He is also charged with possession of a deadly weapon (a knife) by a prohibited person, a class 3 felony punishable by four years in prison, nine to 24 months of post-release supervision and a $25,000 fine. As a convicted felon, Vieselmeyer is prohibited from possession a firearm or other deadly weapons. In 2013, he was convicted in Lancaster County of burglary and theft by unlawful taking, both class 3 felonies.In accordance with the agreement, Vieselmeyer pleaded guilty to a single count of strangulation. The remaining charges were dismissed with prejudice.The defendant was represented by Public Defender Scott Gropp, who noted that his client's criminal history was, “Fairly short but fairly significant.”Vieselmeyer requested probation and blamed his drug addiction for his ‘downfall.’“I understand,” said Vieselmeyer. “The action I took were despicable.”The defendant added, “It's not who I am.”However, Judge Baregn said, “I find the defendant is not a fit candidate for probation.”Vieselmeyer was given two years, with credit for 162 days time served. He was then remanded to the custody of the sheriff's office to carry out the sentence.
