Fairbury Man Pleads Guilty to Domestic Violence in Gage County Court

A Fairbury man was sentenced in Gage County Court to jail and probation for domestic violence.
Dusty E. McCardle, age 37, was originally charged with third degree domestic assault, strangulation and child abuse. All three as charged were a class 3A felonies, punishable by up to three years in prison, 18 months of post-release supervision, and $10,000 fine.


On October 28, 2024, deputies with the Gage County sheriff’s Office were dispatched to a residence in Wymore, regarding a report of a domestic situation in progress.
According to the arrest affidavit, after an argument with McCardle, the alleged victim indicated she locked herself in an upstairs bathroom with her minor daughter. The alleged victim reported, “Dusty followed her upstairs and forced the door open, breaking the lock.”


The minor daughter reported that, “Dusty then grabbed her arm and ultimately grabbed her neck causing her discomfort and compressed her breathing.”
Per the affidavit, deputies observed that the daughter “had visible red marks on the left side of her neck” and a “small amount of blood was on her right ear.”


In accordance with a plea agreement, McCardle pleaded guilty to reduced charges of misdemeanor domestic assault and misdemeanor child abuse. He was sentenced to 60 days in jail and two years of probation.
McCardle has a prior conviction for third degree domestic assault in Lancaster County on November 21, 2008.
