Fairbury Man Sentenced for Sexual Assault

A Fairbury man accused of sexually assaulting a 14-year-old was sentenced to 16 to 18 years in prison.Dylan L. Busing, age 30, appeared in Jefferson County District Court the morning of Thursday, January 4, 2024, in the custody of the Jefferson County Sheriff's Office. David J.A. Bargen was the presiding judge.Busing was originally charged with first degree sexual assault of a child, a class 1B felony, punishable by a minimum of 20 years and up to life in prison. In addition, he will be subject to the provisions of the Nebraska Sex Offender Registry Act.In accordance with the plea agreement, Busing pleaded No Contest to a reduce charge of attempted first degree sexual assault, a class 2A felony punishable by up to 20 years in prison.Busing was 29-year-old at the time of the alleged incident. Because the victim is a minor, the arrest affidavit and other court documents are under seal.The defendant was represented by attorney Benjamin Murray, who requested probation on behalf of his client.Busing was given an opportunity to address the court, “I just want to say I am extremely sorry.”“It was a moment of stupidity and thoughtlessness,” said Busing. “I felt a great shame and regret.”Busing described his actions as, “A temporary lapse in judgment and a mistake I will never make again.”Judge Bargen had ordered a PSI (Pre-Sentencing Investigation), which was received reviewed by the court. The PSI recommended probation. However, Judge Bargen said the defendant was, “Not a fit candidate for probation.”“Sentencing is perhaps the hardest thing a court does,” said the judge. “As you said, what you did was wrong and there must be some accountability for that.”Judge Bargen then sentenced Busing to between 16 and 18 years in the Nebraska Department of Corrections, with credit for 350 days time served.Busing was then remanded to the custody of the sheriff's office to carry out the sentence.
