Fairbury Woman Accused of DUI Withdraws from Plea Agreement

On the day of sentencing, a Fairbury woman withdrew from a plea agreement and informed the court she had hired a new attorney.Skiler A. Henry, age 23, of Fairbury, appeared in Jefferson County Court the afternoon of Wednesday, March 3, 2023. Linda Bauer was the presiding judge.Originally, Henry was charged with first offense DUI (driving under the influence of drugs or alcohol), a class W misdemeanor, and procuring alcohol for a minor, a class 1 misdemeanor, punishable by one year in jail and a $1,000.The offense was alleged to have occurred on June 19, 2022. An investigation was started after a motor vehicle accident. According to Jefferson County Attorney Joseph Casson, the defendant originally told law enforcement she was the driver of the vehicle. Later, she allegedly changed her story and said she was a passenger and another person was driving.In accordance with a plea agreement, Henry pleaded No Contest to a reduced charge of false reporting, a class 1 misdemeanor.The defendant was represented by attorney Ronald Brackle, who negotiated the plea agreement. Henry told the court, “I didn't think Mr. Brackle had my full, best interest at heart.”Henry's new attorney is Dustin Garrison. He did not appear in court but, over the noon hour, filed a motion for a continuance.County Attorney Joseph Casson objected to any continuance, noting, “This matter has been delayed several times.”The judge noted the motion came very late in the proceedings, “We've had a number of issues with Mr. Garrison not doing things in a timely fashion.”“I have a problem with the late nature of the motion,” said Judge Bauer. “I don't hold that against the defendant.”The judge had ordered the defendant to contact the probation Office and completed a PSI (Pre-Sentencing Investigation). However, Henry did not do that.Henry was allowed to withdraw her guilty plea. A continuance was granted.In a separate case, Henry was charged with third degree assault, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine.The alleged incident in question occurred on or about August 27, 2022. Portions of the court file are under seal, so no additional details are available at this time.The plea agreement also encompassed this case.
