Fairbury Woman Admits to Violating Probation

A Fairbury woman accused of violating probation as well as obstructing a peace officer has reached a plea agreement.On June 12, 2024, Terra L. Schultz pleaded guilty in Jefferson County Court to DUI (Driving Under the Influence), a class W misdemeanor. She was sentenced to 12 months of probation.On July 13, 2024, at approximately 7:11 p.m., deputies with the sheriff's officer were dispatched to a residence in Fairbury regarding a possible domestic dispute. Schultz was arrested at the scene. She was charged with obstructing a peace officer, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine. Due to this arrest, as well as other alleged violations of the terms of probation, a motion to revoke probation was filed with the court on November 19, 2024.Public Defender Scott Gropp was assigned to represent her.Schultz appeared on Jefferson County Court on Wednesday, November 20, 2024. Linda Bauer was the presiding judge. County Attorney Joseph Casson had tendered a plea offer but Gropp had been unable to present it to his client. He said that Schultz no longer wanted him to represent her and wanted a new attorney.Schultz told the court that she was unhappy with Gropp, accusing him of not returning phone calls.Judge Bauer expressed her doubt, “I'm not willing to place the blame on his shoulders at this moment.”The judge advised Schultz that Gropp was the public defender and she would not be assigning a different attorney. If she wanted a new attroeny, she would have to hired one herself.Schultz then agreed to allow Gropp to continue to represent her. In accordance with the plea agreement, Schultz admitted to the probation violations. In return, the prosecutor agreed to dismiss the obstruction case.The judge ordered a PSI (Pre-Sentencing Investigation) update from the Probation Office.Sentencing is scheduled for December 16, 2024.
