Fairbury Woman Sentenced for Third Offense DUI

A Fairbury woman was sentenced to 90 days in jail for a third offense DUI (driving under the influence of alcohol or drugs) in Gage County. A firearm charge was dismissed.Brandee N. Freauf, age 49, was arrested in Beatrice on June 13, 2023. At approximately 11:12 p.m. on that date, the Beatrice Police Department was dispatched to the scene of a vehicle stuck on the railroad tracks at Southwest 32nd Street and Blue Ridge Drive.According to the officer that filled out the probable cause affidavit, Freauf was in the driver's seat, “I could immediately tell Freauf was very unsteady on her feet with blood shot watery eyes. Freauf gave me permission to look for her license. While looking for her license I looked in the center consol (sic) and saw a firearm in it. The firearm was a Ruger .380 and had bullets in the magazine.”The officer was unable to find the defendant's driver's license and learned that Freauf had been arrested in Lincoln for third offense DUI on June 5, 2023, and had already been issued and Administrative License Revocation form from that arrest.The officer also reported that Freauf refused to perform some field sobriety maneuvers, although she did submit to a preliminary breath test resulting in .376.Freauf had originally been charged with third offense refusing to submit to a test, a class 3A felony, punishable by a maximum of three years of imprisonment and 18 months of post-release supervision. She was also charged with use of a firearm to commit a felony, a class 1C felony punishable by a minimum of fives years and a maximum of 50 years in prison.In accordance with a plea agreement, the defendant pleaded guilty to a reduced charge of third offense DUI, a class W misdemeanor. The other charges were dropped.Freauf was sentenced to 90 days in jail, with credit for 28 days time served; fined $1,000 and her license was revoked for 15 years.
