Four Arraignments – Four No Shows – Four Warrants

No defendants were present when Jefferson County Court began at 9:30 a.m. on Wednesday, June 14, 2023. Four defendants were scheduled to be arraigned that day. It is not unusual for some defendants not to appear but the presiding judge, Linda Bauer, noted, “Usually, at least 50 percent show up.”The defendants each had signed a citation or bond promising to appear and arrest warrants were issued for all four.Jonathan S. Barnett, age 21, of Brunning, did appear for court approximately 15 minutes late and Judge Bauer agreed to recall the warrant. She warned the defendant to appear for court on time in the future.Barnett is charged with DUI (Driving Under the Influence of Alcohol), a class W misdemeanor punishable by seven to 60 days in jail, a $500 fine and a six month driver's license revocation.On April 30 of this year, at approximately 2 a.m., a deputy with the Jefferson County Sheriff's Office witnessed a green Chevy pickup truck drive into the south ditch of Highway 136 near River Road.The defendant failed sobriety tests and was taken into custody.Barnett waived his right to counsel and pleaded guilty to both charges.Judge Bauer asked, “Do you wish to be considered for probation?”Barnett answered, “It would be kinda nice.”The judge ordered an alcohol evaluation and set sentencing for August 2.George Leon Theodor, age 33, of Omaha, is charged with driving without a valid license and without valid registration, both class 3 misdemeanors punishable by up to three months in jail and a $500 fine. He is also charged with no proof of insurance, a class 2 misdemeanor punishable by up to six months in jail and a $1,000 fine.According to County Attorney Joseph Casson, Theodor’s license had been suspended in Kansas.This is not the first time a warrant has been issued for Theodor for failing to appear on this case. He was issued a citation on September 2, 2022. He failed to appear for court as scheduled on September 28 and Judge Bauer issued a warrant at that time.Theodor was picked up by law enforcement in Omaha on May 18, 2023. He was released on a $2,500 (10 percent) bond.Judge Bauer set a new bond at $3,500.Tyler S. Creek, age 28, of Beatrice, is charged with driving under a suspended license, a class 3 misdemeanor. His license was suspended after failure to pay child support. Judge Bauer set a bond at $1,500 (10 percent).Rachelle L. Milligan, age 19, of Fairbury, is charged with shoplifting a value of less than $500, a class 2 misdemeanor. Judge Bauer issued a bond at $1,500 (10 percent).
