Hebron Man Gets Two Years Probation for Drug Offense

A Hebron man was sentenced to 24 months of probation for drug possession.
John A. Jacobitz, age 53, appeared in Gage County Court on June 12, 2024. Rick A. Schreiner was the presiding judge.
Jacobitz was charged with possession of a controlled substance, a class 4 felony punishable by up to two years in prison and a $10,000 fine. In accordance with a plea agreement, a charge of possession of drug paraphernalia. An infraction, was dismissed.
On January 17, 2023, at approximately 5:50 a.m., a deputy with the Gage County Sheriff’s office was dispatched for a welfare check after a male was reported to be sleeping in a vehicle on State Highway 41 and S 82 Road.
According to the arrest affidavit, upon arriving at the scene, the deputy located a maroon Ford pickup truck with Nebraska license plates, “I walked up to the vehicle and I observed a male slumped over sleeping in the driver side seat. This male was the only occupant of the vehicle. I made contact with the male by knocking on the glass of the driver side window to make sure he was okay. At this time, the male woke up and opened the driver’s side door.”
Jacobitz identified himself and gave permission to the deputy to search the vehicle.
Per the affidavit, “During the search of the vehicle, I located a gray and yellow zippered bag laying on the front passenger seat Inside the zippered bag was a plastic baggie with a white crystalline substance. I field tested the white crystalline substance which tested positive for methamphetamine. Also, inside the zippered bag was a methamphetamine pipe with burnt residue inside the pipe. In the driver side door storage area, I located a clear cylinder tube with white residue inside the tube along with a plastic baggie which contained a white residue inside the baggie. On the front passenger dashboard there was a suspected broken methamphetamine pipe.”
