Jacobitz Gets Four Months For Assault

John A. Jacobitz, 51, of Fairbury, was sentenced in Jefferson County Court on Wednesday, March 9, 2022. Linda Bauer was the presiding judge.Jacobitz was originally charged with third degree domestic assault and first offense resisting arrest, both class 1 misdemeanors punishable by one year in jail and a $1,000 fine. The defendant was arrested on a Warrantless Arrest Affidavit on Saturday, November 6, 2021.In accordance with a plea agreement, Jacobitz pleaded Guilty to the assault charge and the resisting arrest charge was dismissed.Jacobitz failed to appear for sentencing on February 2 of this year. Judge Bauer issued a warrant for his arrest and sentencing was rescheduled for March 9.A PSI (Pre-Sentencing Investigation) to be prepared by the Probation office was ordered by the judge and reviewed by the court. The defendant's attorney, Public Defender Scott Gropp, said, “Probation does not feel my client would be a good candidate for probation.”Gropp therefore requested a straight sentence.Judge Bauer concurred and sentenced Jacobitz to 120 days in jail.Jacobitz was surprised at the length of the jail term, according to Gropp, who said, “He wasn't expecting quite that much.”Jacobitz asked for a deferred sentenced to give him time to make some arrangements. The judge agreed and ordered Jacobitz to turn himself in Monday morning, March 14. The judge also warned Jacobitz that, if he failed to comply, a warrant would be issued for his arrest and he could face additional charges.This was not the only case Jacobitz had to respond to for that day. He was also arraigned on a charge of having no proof of insurance on his vehicle.Jacobitz insisted, “I've never been driving my vehicle.”County Attorney Joseph Casson explained that, while the defendant was not driving, he allegedly allowed someone else to drive the vehicle without insurance.Casson also indicated he was not seeking jail time, so the defendant was ineligible for court-appointed counsel. Judge Bauer asked Jacobitz time to consult with an attorney. Jacobitz said, “I just want to get it over with.”The defendant pleaded No Contest and was fined $100.
