Jansen Man Accused of Assault, Strangulation

John A. Jacobitz, age 52, of Jansen, appeared in Jefferson County Court via webcam on Wednesday, June 7, 2023, in the custody of law enforcement. Linda Bauer was the presiding judge.Jacobitz was arraigned on four counts: third degree domestic assault, strangulation, terroristic threats and false imprisonment. Each charge is a class 3A felony punishable by three years in prison, nine to 12 months of post-release supervision and a $10,000 fine.On May 23, 2023, at approximately 11:06 a.m., the Jefferson County Sheriff's Office responded to a report of a domestic disturbance in Jansen. According to the Warrantless Arrest Affidavit, “It was reported a male had pushed a female into a car and they left.”Deputies spoke to witnesses and then engaged in a search for the vehicle.According to the affidavit, at approximately 1:24 p.m.,“I was informed by dispatch of a suspicious vehicle being a Buick Lesabre or something that was stopped on the road approximately one- and one-half miles south of the intersection of 722 Road and 574 Avenue in Jefferson County.”Deputies reported locating the vehicle stopped near that location, finding both Jacobitz and the alleged victim standing outside the vehicle.Jacobitz was arrested at the scene. The alleged victim was transported to Jefferson Community Health and Life by ambulance.Bond was originally set at $75,000 (10 percent). The defendant's attorney, Dillon O'Doherty, told Judge Bauer his client was unable to pay and asked for a PR (Personal Recognizance) bond, “I do not believe Mr. Jacobitz is a flight risk.”County Attorney Joseph Casson opposed a PR bond but said some reduction might be in order.Judge Bauer agreed a PR bond was not appropriate, citing the defendant's “significant criminal history,” but agreed to lower the bond to $50,000 (10 percent).The bond includes a condition of no contact with the alleged victim.The case was continued until July 14.This is not the first time Jacobitz has been accused of assault or strangulation.On March 9, 2022, Jacobitz was sentenced to four months in jail for assault in Jefferson County Court. Linda Bauer was the presiding judge.Jacobitz was originally charged with third degree domestic assault and first offense resisting arrest, both class 1 misdemeanors punishable by one year in jail and a $1,000 fine. The defendant was arrested on November 6, 2021. In accordance with a plea agreement, Jacobitz pleaded Guilty to the assault charge and the resisting arrest charge was dismissed.In another case, Jacobitz was arrested in Thayer County on June 24, 2022, for strangulation. He was sentenced in Thayer County District Court to 350 days in jail.
