Jody Duke Arrested For Assault

An ambulance was dispatched to the scene of an alleged assault Monday morning, February 14, shortly before 9 a.m., at the 1000 block of 6th Street in Fairbury. One individual was taken to the hospital.Arrested for the alleged assault was Jody W. Duke, 40, of Fairbury.Duke appeared in Jefferson County Court on Wednesday, February 16, 2021, via webcam in the custody of the Jefferson County Sheriff's Office. Linda Bauer was the presiding judge.No charges were on file yet but Duke was arrested for third degree domestic assault with prior conviction, making the possible charge a class 3A felony, punishable by three years in prison, nine to 18 months of post-release supervision and a $10,000 fine.Duke requested court-appointed counsel. Public Defender Scott Gropp is unable to defend Duke as he has a conflict of interest. Therefore, Judge Bauer assigned Attorney Benjamin Murray to represent Duke.Bond had not yet been set. Judge Bauer explained, “The court previously found that probable cause existed for your detention but declined to set a bond at the time.”The judge said, “Obviously, I'm aware of your criminal history and the fact that you probably haven't been out of jail all that long before that happened. So based on those things, I guess I wanted to hear from the State before I set any bond in this matter. Does the State have any recommendations for bond?”County Attorney Joseph Casson said, “I expect this to be a felony filing, so I'd ask for $50,000, 10 percent.”Duke indicated he was unable to pay that amount.Judge Bauer said, “Well, as I said, I am familiar with your criminal history and particularly for this type of offense. I think that the state's request at this point is probably reasonable. I understand you probably couldn't make any cash bond so I'm not sure even if I lowered it in half that it would really help you at this point.”The judge set bond at $50,000 with a provision that Duke have no contact with the alleged victim.Another hearing is set for March 2.Duke has a string of prior arrests and convictions in Jefferson County, including prior convictions for domestic assault.
