Kansas Drug Suspect Gets Probation

Makela L. Grable, age 23, of Marysville, Kansas, was sentenced to probation in Jefferson County on September 11, 2024. Linda Bauer was the presiding judge.Grable was originally charged with possession of a weapon, brass knuckles, by a prohibited person, a class 3 felony punishable by up to four years in prison and two years of post-release supervision. Grable was previously convicted of a felony in Kansas and is on probation. As such, she is not allowed to possession such a weapon. In addition, Grable was charged with possession of methamphetamine, a class 4 felony punishable by up to two years in prison, nine to 12 months of post-release supervision and a $10,000 fine, as well as possession of drug paraphernalia, a infraction that carries a $100 fine.In accordance with a plea agreement, Grable pleaded guilty to a reduced charge of attempt of a class 4 felony, which is a class 1 misdemeanor.Grable was arrested by the Jefferson County Sheriff's Office during a traffic stop on Thursday, February 22, 2024. At approximately 12:30 p.m. a deputy with the sheriff’s office conducted a traffic stop near the intersection of 9th and F Streets in Fairbury for a traffic offense. According to a press release, “During the stop, the deputy located controlled substances and drug paraphernalia within the vehicle.”The driver of the vehicle was identified as Grable. A passenger in the vehicle was identified as Macon J. Kaer, age 37, of Fairbury. According to the arrest affidavit, Grable gave consent to law enforcement to search the vehicle, “In the vehicle's passenger seat, where Kaer was seated, was an unused syringe and a bag of syringes stuffed between the passenger seat and center console. In the back seat, I discovered a black bag with two syringes, one of which contained an unknown substance. There was also a pair of brass knuckles. In the back panel of the drivers seat was a large spoon, containing a white crystal-like substance. This later tested positive for methamphetamine.”Both were taken into custody and booked into the Jefferson County Jail.The defendant was already on probation in Kansas at the time of sentencing. Judge Bauer said, “I am impressed by the progress you've made.” The judge gave the defendant six months of probation to the court, meaning Grable does have to report to both Nebraska and Kansas probation offices. The judge explained, “There's really no reason for two probations going on.” The judge also pointed out that if her Kansas probation is revoked, Grable could still be sentenced up to one year in this matter.Grable was also fined $250.
