Kansas Man Reaches Plea Agreement in Trespassing Case

David J. Stirm, age 25, of Hollenberg, Kansas, was sentenced in Jefferson County Court on Wednesday, May 26, 2023. Linda Bauer was the presiding judge.Stirm was originally charged with first degree criminal trespass, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine, and possession of burglar's tools, a class 4 felony punishable by up to two years in prison and a $10,000 fine.According to the Warrantless Arrest Affidavit, Jefferson County deputies were dispatched to an address near Diller, responding to a 911 call. Upon arrival, the deputy that filled out the affidavit noted seeing the suspect leaving a structure at the scene, “When I made contact with the individual, he stated that his car had broken down here and that he had been calling for help.”Inside the structure, the deputy reported finding, “a backpack with various tools inside to include hatchets, hammers and a drill with drill bits.”The deputy also found, “three pistols all loaded and chambered.”The defendant was placed under arrest at the scene.In accordance with a plea agreement, Stirm pleaded No Contest to criminal trespass. The remaining charge was dismissed. The defendant also agreed to surrender all the firearms confiscated by law enforcement.As a part of the plea agreement, County Attorney Joeph Casson agreed to recommend a fine only.Stirm was represented by Public Defender Scott Gropp, who pointed out the guns were lawfully possessed by his client.Judge Bauer asked why surrendering the guns was part of the plea agreement.Casson said, “The defendant has other issues,” that made possession of weapons “in this jurisdiction” an issue. He did not clarify.Judge Bauer sentenced the defendant to three days in jail, with credit for three days time served, and a $250 fine.
