Lincoln Man Accused of Violating Protection Order Multiple Times Reaches Plea Agreement

A Lincoln man accused of multiple violations of a protection order has reached a plea agreement with the state.Terrell C. Luckes, age 48, of Lincoln, appeared in Jefferson County Court on Wednesday, January 31, 2024, via webcam, from the Jefferson County Jail. Linda Bauer was the presiding judge.Luckes had three cases pending.In one case, Luckes was charged with violating a protection order and criminal trespass, both class 1 misdemeanors punishable by up to a year in jail and a $1,000 fine. The offense is alleged to have occurred on or about December 14, 2023.In another case, Luckes was charged with violating a protection order on December 4, 2023.In the third case, Luckes was again charged with violating a protection order and criminal trespass on January 12, 2024.In accordance with the plea agreement, the defendant pleaded guilty of one count of violating a protection order and one count of criminal trespass. The remaining charged were dismissed.Judge Bauer orders a PSI (Pre-Sentencing Investigation). Sentencing is scheduled for February 28, 2024.With two of the three cases dismissed, the bond on the remaining case was $2,500, which Luckes had paid before being re-arrested.The defendant's attorney, Public Defender Scott Gropp, told the judge his client would return to Lincoln immediately upon release.However, County Attorney Joseph Casson said, “All I can say is, he repeatedly says he is going back to Lincoln but repeatedly shows up back here.”Casson asked that the bond be revoked to prevent the defendant from being released before sentencing, “Otherwise we run the risk of being right back here in a couple or three days.”Judge Bauer said, “I'd be concerned he wouldn't show up for sentencing.”She revoked the bond and set a new bond at $10,000.
