Lincoln Man Pleads Guilty to Burglary

Parker R. Viets, 21, of Lincoln, was sentenced in Jefferson County District Court on Thursday, April 28. 2022. He appeared in court in the custody of the Jefferson County Sheriff’s Office Julie Smith was the presiding judge.Viets was originally charged with burglary, a class 2A felony that carries a possible penalty of 20 years in prison; possession of a controlled substance, methamphetamine, a class 4 felony punishable by two years in prison, 12 months of post-release supervision and a $10,000 fine; and possession of drug paraphernalia, an infraction that carries a $100 fine.On December 3, 2019, at approximately 1:44 p.m., the Jefferson County Sheriff's Office was informed of a possible break-in at a residence in Fairbury. The reporting party identified one suspect inside the house as Viets.Sheriff's Deputies went straight to Highway 136, traveling eastbound in anticipation of the suspect's vehicle and its occupants heading towards Beatrice. Deputies drove to the county line without making contact and Jefferson County Dispatch radioed Gage County.Gage County law enforcement made contact with the vehicle near the Southeast Community College Campus. Viets and two other individuals in the vehicle were detained.At approximately 2:28 p.m., a Jefferson County Deputy arrived on the scene. The other two individuals were questioned. According to the Warrantless Arrest Affidavit, “both stated they did not realize Viets was robbing anyone until well after the fact.”However, Viets indicated it was one of the others, “that went into the house and took stuff.”The vehicle and the area around the vehicle were searched and, per the Affidavit, “I found a small bag containing a white powdery residue on the floorboard.”Also located was a broken glass pipe, multiple pill bottles, another bag and a bent metal spoon. The spoon field-tested positive for methamphetamine. Viets was arrested at the scene and transported to the Jefferson County Jail.Viets pleaded Guilty to all charges.Viets spoke to the court prior to sentencing.“I deeply regret my choice,” Viets said. “Now I have to accept the consequences.”A PSI (Pre-Sentencing Investigation) indicated the defendant was not a suitable candidate for probation and the judge concurred. She told the defendant, “I don’t plan my sentencing in advance.”On the charge of burglary, Viets was sentenced to no less than 12 months and no more than 44 months in the Nebraska Department of Corrections.On the charge of possession of methamphetamine, he was sentenced to no less than 12 months and no more than 24 months in the Nebraska Department of Corrections.Those sentences are to run concurrently, meaning at the same time. He was given credit for 301 days’ time served.The defendant was also fined $100 for possession of drug paraphernalia.Viets was then remanded to the custody of the Sheriff’s Office to carry out the sentence.
