Lincoln Woman Accused of Attempted Burglary Sentenced

Dominique Desiree Tierney, age 29, of Lincoln, appeared in Jefferson County Court in the custody of the Jefferson County Sheriff’s Office on Wednesday, January 10, 2024. Linda Bauer was the presiding judge.
Tierney was charged with attempt of a class 1 misdemeanor (trespass), which is a class 2 misdemeanor. She had originally been arrested for attempted burglary, a felony, but the charge was later reduced. She was also charged with criminal mischief resulting in damage between $500 and $1,500, a class 2 misdemeanor; disturbing the peace, a class 3 misdemeanor; and unlawful acts relating to drugs, also a class 3 misdemeanor.
On October 28, 2023, at approximately 5:09 a.m., deputies responded to a report of an attempted break-in. According to the Warrantless Arrest Affidavit, at approximately 5:14 a.m., dispatch advised, “there was a window broken and a person was still beating on the windows.”
A female suspect, later identified as Tierney, was arrested at the scene.
Although Public Defender Scott Gropp had been assigned to represent her, she waived her right to an attorney and pleaded guilty to all counts.
Tierney told the court, “I promise it won’t happen again because I like my freedom.”
County Attorney recommended a straight sentence.
The defendant also has a pending case in Lancaster County. Judge Bauer told Tierney, “I don’t think there is purpose to you sitting in our jail any longer.”
The judge sentenced Tierney to 120 days in jail, with credit for 75 days time served. With good time and time served credit, Tierney was released from the Jefferson County Jail and transported to Lincoln.
