Motion To Halt Gage County Swine Facility Dismissed

By Gordon HopkinsA motion for a Temporary Restraining Order filed by opponents of a controversial swine operation in Gage County has been dismissed by the plaintiffs.The court filing was intended to delay Gage County Supervisors approving a special use permit for a proposed CAFO (concentrated animal feeding operation) near Liberty. The Island Grove Summit Swine CAFO is expected to hold an estimated 6,200 animals in section 25 of Island Grove Township, just north of Liberty and near the Gage-Pawnee County line.The land belongs to Otto Farms, which would provide the land to build the facility and then use the liquid hog manure from the CAFO to be injected as fertilizer on farm ground.The motion was originally filed October 13, 2023. Patricia Barnard, Clint Rule, Vicky White and Margaret Haith are listed as plaintiffs and are represented by attorney Timothy J. Buckley of Omaha. Gage County District Court Judge Rick A. Schreiner denied the motion on Monday, October 16, but scheduled another hearing is scheduled for October 30.The plaintiffs requested a dismissal.FJN reached out to Vicky White for a comment. As of press time, no response was received.Judge Schreiner's ruling may not be the end of possible legal action. At a hearing in front of Gage County Supervisors on Wednesday morning, October 18, 2023, a number of opponents spoke. Liberty resident Don Singleton warned, if the supervisors approve the permit, “There will be a lawsuit.”Approval of the special use permit has already been recommended by the Gage County Planning and Zoning Committee. Gage County Supervisors were scheduled to make a final decision at a meeting on Wednesday, November 1, 2023.
