Report Of Loud Party Leads To Arrests On Drug Charges

Jane E Maitland, 65, of Fairbury, appeared in Jefferson County Court on Wednesday, September 8. Linda Bauer was the presiding judge.The defendant is charged with possession of methamphetamine, a class 4 felony punishable by two years in prison, followed by nine to 12 months of post-release supervision and a $10,000 fine. She is also charged with possession of drug paraphernalia, an infraction that carries a $100 fine.On July 20, 2021, shortly after midnight, Jefferson County Deputies were dispatched to a residence in Fairbury in response to a 911 call about a loud party.The reporting party was James E. Jacobson, 53, of Fairbury, Jacobson was the reporting party and he indicated that an individual with a gun was in the hallway of the apartment building where he was located. According to the Warrantless Arrest Affidavit, “No individuals were located in the hallways of the apartment building.”The Affidavit also noted that previously that day, “Jacobson was concerned somebody was 'after him' and had followed him to Fairbury from South Dakota.”The Affidavit indicates deputies attempted to make contact with the defendant, “I knocked several times and announced 'Sheriff's Office' and got no response. Based on the circumstances of Jacobson reporting someone had a firearm and him being concerned prior about his safety, entry was made into the apartment.”The Affidavit indicates Maitland was found sleeping in the apartment.According to the deputy who filled out the Affidavit, upon entering the apartment, “I observed in plain view a suspected methamphetamine pipe with residue on a stool next to the bed.”The deputy also wrote, “The methamphetamine pipe was field tested and tested positive for methamphetamine. A sample of the evidence will be sent to the Nebraska State Patrol Crime Lab for further testing.”Both Maitland and Jacobson were arrested at the scene.The deputy also noted, “While being booked into the Jefferson County Jail, a search of Maitland's wallet was conducted. A small baggy with a white, crystal like substance was located.”Jacobson was arraigned on Wednesday, August 18. He is represented by Public Defender Scott Gropp.Maitland is represented by attorney Gregory Kratz, who requested a 30 day continuance. Kratz indicated a possible agreement was in the works and asked the judge to set the case for disposition without trial. The next hearing is set for October 20.
