Sentencing for Assault Case Delayed Due to Confusion Over Credit for Time Served

A Fairbury man scheduled to be sentenced for assault has had his case delayed one week as the defense and prosecution have a dispute over the amount of credit for time served he should receive.Lynn William Vieselmeyer-Scheetz, age 31, appeared in Jefferson County District Court on Thursday, September 4, 2025, in the custody of the Jefferson County Sheriff’s office. David J.A. Bargen was the presiding judge. Vieselmeyer-Scheetz was originally charged with first degree sexual assault, a class 2 felony punishable by one to 50 years in prison. In accordance with a plea agreement, the defendant pleaded no contest to a reduced charge of assault causing bodily injury, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine.The incident allegedly took place on October 31, 2024. The affidavit is currently under seal.A PSI (Pre-Sentencing Investigation) was completed by the probation department prior to the sentencing date and available for review by the court. According to the PSI and defense attorney Benjamin Murray, the total amount of time served should be 173 days. However, Jefferson County Attorney Jospeh Cassson asserted that the correct amount is actually only 45 days. According to Casson, Vieselmeyer-Scheetz had been arrested on another matter and some of the time served in the PSI calculation should actually go toward that case. Other CaseOn October 5, 2023, Jefferson County District Court Judge David J.A. Bargen sentenced Vieselmeyer-Scheetz to two years, with credit for 162 days time served, to be followed by 18 months of post-release supervision. In that case, Vieselmeyer-Scheets was originally charged with assault by strangulation or suffocation, a class 3A felony punishable by up to three years in prison, plus nine to 18 months of post-release supervision, and third-degree domestic assault, a class 1 misdemeanor punishable by one year in jail and a $1,000 fine. On March 6, 2025, the defendant’s post-release supervision was revoked after being accused of absconding. Judge Bargen sentenced him to 18 months of incarceration. What Happens Next?Judge Bargen was unwilling to go forward with sentencing until the discrepancy was sorted out. He ordered the case continued for one week. The next court date is September 11, 2025. The defendant remains in custody at this time.
