Trial Set for Wymore Man Charged with Domestic Assault

Michael A. Wilcox, age 43, of Wymore, appeared in Gage County Court on Tuesday, August 23.Wilcox is charged with third degree domestic assault, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine, and disturbing the peace, a class 3 misdemeanor punishable by three months in jail and a $500 fine.The charges stem from a citation issued November 20, 2021. The charges are a refiling. According to the Affidavit in Support of Arrest Warrant, the defendant enrolled in the Gage County Diversion and Community Service program on January 14, 2022.A diversion program is a form of pretrial sentencing that offers the opportunity for individuals charged with criminal offenses to avoid having a criminal conviction on their record. First-time offenders may have the option of participating in a such a program rather than have criminal charges filed against them in court.Upon verification of enrollment, the County Attorney dismissed the case.On June 8, 2022, the County Diversion and Community Service program coordinator sent a letter to Wilcox, advising his he still needed to pay required program fees and provide proof of community service.No response was received and charges were refiled. A warrant was issued for the defendant’s arrest on June 16.Wilcox is represented by attorney Lee M. Timan. A bench trial is scheduled for November 1, 2022.Wilcox remains free on a $5,000 (10 percent) bond.
