Warrant Issued for Beatrice Man Accused of Violating Protection Order

A warrant was issued for Scott A. Goin, 32, of Beatrice, after failing to appear for Jefferson County Court on Wednesday, April 20, 2022. Linda Bauer was the presiding judge.Goin is charged with violating a protection order, a class 1 misdemeanor punishable by one year in jail and a $1,000 fine.The defendant was previously scheduled to appear in court on April 13 but did not appear. He contacted both his attorney, Public Defender Scott Gropp, and the court, indicating his ride had broken down. Judge Bauer agreed to a continuance at that time.The defendant was free on a $3,500 (10 percent) bond,Gropp requested a further continuance, which was denied by the court. A warrant was issued, the bond was revoked and a new bond was set in the amount of $5,000 (10 percent).ArrestOn February 26, 2022, at approximately 7:03 p.m., deputies with the Jefferson County Sheriff's Office were dispatched to the Walmart in Fairbury at the request of the Walmart Asset Protection Manager. According to the Warrantless Arrest Affidavit, security video of an alleged shoplifting incident showed the defendant in the company of a woman, who was later identified as the “protected party” in a protection order.Goin was arrested at the scene. He has not been charged with shoplifting.Goin pleaded Not Guilty.Criminal HistoryThis is not Goin's first brush with the law. He was previously convicted of violating a protection order in Gage County on October 26, 2021.According to the Beatrice Police Officer that filed out the Arrest Affidavit, law enforcement responded to a report of yelling in an apartment in Beatrice on October 4, 2021, “Upon arrival, I spoke with the victim. Victim told me that the television was the cause of the noise. I told her that I knew of a Protection Order and that I believe that Scott A. Goin is in the apartment. Victim stated that he was not. When I asked to come in, she broke down crying and told me that he is hiding in a closet. I called Scott A. Goin out of the closet and he came out. Scott A. Goin told me that he was staying there because he did not have anywhere else to go. Scott A. Goin was placed under arrest for the above listed charge. He was booked and lodged in the Gage County Detention Center.”The affidavit also noted, “The Ex Parte Domestic Abuse Protection Order states that the Respondant (sic), Scott A. Goin, is enjoined and prohibited from telephoning, contacting, or otherwise communicating with the petitioner, Victim.”Goin was sentenced to 22 days in jail.The victim in the 2021 case is the same as this current case.
